Terms of Service

1. Acceptance of Terms

By accessing or using Roost (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. We reserve the right to update these terms at any time. Continued use after changes constitutes acceptance.

2. Eligibility

Roost is intended for current and incoming students of McMaster University and other Canadian post-secondary institutions. To post a listing, you must verify your student email address. By using the Platform, you represent that the information you provide is accurate and up to date.

3. Use of the Platform

You agree not to:

• Post false, misleading, or fraudulent listings
• List a property you do not have the right to sublet or transfer
• Harass, threaten, or deceive other users
• Use the Platform for any unlawful purpose
• Scrape, crawl, or otherwise extract data from the Platform without permission
• Circumvent any authentication or security feature

We reserve the right to remove any listing or suspend any account that violates these terms, at our sole discretion.

4. Listings

Roost is a marketplace that connects students. We do not own, manage, or control any of the listed properties. We are not a party to any rental agreement between users. It is your responsibility to verify any listing before entering into a rental arrangement, and to comply with all applicable landlord-tenant laws in Ontario.

5. Intellectual Property

By posting content on Roost (including photos, descriptions, and other materials), you grant us a non-exclusive, royalty-free licence to display that content on the Platform. You retain ownership of your content. You represent that you have the right to share any content you upload.

6. Disclaimer of Warranties

The Platform is provided “as is” and “as available” without any warranties, express or implied. We do not guarantee the accuracy of any listing, the identity of any user, or the outcome of any rental arrangement. Use the Platform at your own risk.

7. Limitation of Liability

To the fullest extent permitted by law, Roost and its operators will not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including but not limited to losses resulting from reliance on listings, failed rental arrangements, or unauthorized access to your account.

8. Third-Party Services

The Platform uses third-party services including Supabase (authentication and data storage) and Resend (email delivery). These services have their own terms and privacy policies. We are not responsible for the practices of third-party service providers.

9. Governing Law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario.
